Description
The applicant is requesting a minor variance from Zoning By-law 150-85 to permit a planting strip not less than 1.5 m (5 ft.) in width with a chain link fence 1.5 m (ft.) in height along the eastern and southern property lines and no fence along the northern property line whereas the zoning by-law requires a 1.5 m high solid board on board fence adjacent to an open space or residential zone. The application is currently under site plan review (SP27/19) for a proposed three storey mixed use commercial/residential development. The proposed development is able to meet the requirements of the zoning by-law; however, the City has requested a chain link fence as opposed to a solid fence along the boundaries adjacent to the existing trail along the Grand River. Additionally, the subject property is adjacent to the McDougall Cottage Historic Site and Regional staff would like to maintain the existing fence along the shared boundary to the north of the subject property.
What this kind of application is
The Committee of Adjustment decides minor variances (small exceptions to the zoning by-law, such as a reduced setback or an extra unit) and consents (severing a lot, or adding an easement). Nearby owners are mailed a notice and can speak at the hearing.
