Description
The applicant is requesting a minor variance from Zoning By-law 150-85 to permit an extension to a legal non-conforming use. The existing house has a deficient front and side yard setback and the applicant is proposing to build a second storey on the existing footprint in order to create a duplex dwelling. The zoning by-law permits an addition to an existing building provided the non-conforming front yard is not further reduced as a result of the extension. The applicant is also requesting a reduction to the interior side yard setback to approximately 0.6 m (2 ft,) whereas the zoning by-law requires a minimum 1.5 m (4.9 ft.) setback in order to construct the second storey addition. The subject property is adjacent to a Heritage Designated property. The Municipal Heritage Advisory Committee (MHAC) waived the requirement for a Heritage Impact Assessment (HIA) at the November MHAC meeting.
What this kind of application is
The Committee of Adjustment decides minor variances (small exceptions to the zoning by-law, such as a reduced setback or an extra unit) and consents (severing a lot, or adding an easement). Nearby owners are mailed a notice and can speak at the hearing.
