The garage has an approximate rear yard setback 0.43 m (1.4 ft.) and a side yard setback of 0.23 m (0.75 ft.) whereas 0.6 m (1.9 ft.) is required for accessory structures in the rear yard. In addition to legalizing the location of the existing garage in the rear yard, the applicant requires a minor variance from Zoning By-law 150-85 to permit the proposed garage addition which extends into the side yard. The Municipal Heritage Committee (MHAC) waived the request for a Heritage Impact Assessment. The subject property is on the City's Heritage Register and the proposal has been heard by the Municipal Heritage Committee (MHAC) who had no objection.
