Description
The applicant is requesting a minor variance from Zoning By-law 150-85 to permit the lot frontage on a condominium street whereas the by-law only requires lot frontage on an open public street. The property is subject to a site specific provision 4.1.355 for the 195 Hespeler Road apartment development. The applicant is requesting a minor variance to permit the site-specific zoning regulations approved for the subject lands through By-law 142-18 to be applied to the entirety of the lands zoned RM1 S.4.1.355. Due to the Draft Plan of Condominium being submitted to the Region of Waterloo. The requested variance is to ensure that the site-specific regulations continue to apply to 195 Hespeler Road despite the creation of lot lines by registration of condominium for the purposes of ownership and financing. The Draft Plan of Condominium will result in separate ownership for the two apartment buildings so that each landowner can obtain separate financing for their portion of the property. The variance will facilitate the Draft Plan of Condominium being submitted concurrently to the Region of Waterloo, to allow separate financing which is a condition from Cambridge Housing. Separate financing is required in order to obtain funding for the affordable housing component of the project. The subject property has undergone a site plan review (file SP13/18) and has been approved. The requested variances will not result in any changes to the Site Plan approved development. The subject property is located in a Source Water Protection Area.
What this kind of application is
