Description
The applicant is requesting a minor variance from Zoning By-law 150-85 to accommodate an extension to a legal non-conforming use. The existing semi-detached dwelling was originally built in 1890; however, the lands are now zoned M3 Industrial in the current Zoning By-law. The applicant is requesting an extension of a non-conforming use to accommodate the height increase of the reconstruction of the semi-detached dwelling. The dwelling is being rebuilt after the original structure was damaged due to a fire. The applicant is requesting a maximum height of 7.80 m (25.0 ft.) whereas 6.10 m (20 ft.) was approximately the original height of the dwelling. This application was deferred by the Committee of Adjustment to allow the applicant to address the eaves encroaching onto the neighbouring property.
What this kind of application is
The Committee of Adjustment decides minor variances (small exceptions to the zoning by-law, such as a reduced setback or an extra unit) and consents (severing a lot, or adding an easement). Nearby owners are mailed a notice and can speak at the hearing.
