Description
As background, standard condominiums are an ownership type where the unit owner only owns the dwelling unit. Those units are located on one lot under collective condominium ownership. In a common element condominium, each unit owner owns a dwelling on a separate saleable lot, and the development includes additional land owned in common as well. Those commonly owned lands have no units but can include features such as roads, visitor parking, landscaping, amenity area, etc. Currently Zoning By-law 150-85 only applies to standard condominium developments for townhouses on one overall lot. In this case, the applicant is requesting an interpretation of Zoning By-law 150-85 under Section 45(2)(b) of the Planning Act to permit the zoning to be applied to each unit in the 82 unit townhouse development, rather than the entire block to which site specific zoning S.4.1.303D applies.
What this kind of application is
The Committee of Adjustment decides minor variances (small exceptions to the zoning by-law, such as a reduced setback or an extra unit) and consents (severing a lot, or adding an easement). Nearby owners are mailed a notice and can speak at the hearing.
